Gamevasion powered by DreamHack (in the following “Gamevasion”) is an esports and gaming festival with an expo, esports tournaments and a LAN party. Gamevasion is organized by Freaks 4U Gaming GmbH, An der Spreeschanze 10, 13599 Berlin (“Organizer”). The following conditions of participation and the house rules of Deutsche Messe apply to visitors (“Visitors”) and LAN participants (“LAN Participants”) of the event.

General access regulations

Access to the event site is only permitted with a valid ticket. The terms and conditions governing the purchase of a ticket to Gamevasion can be accesses here: https://vivenu.com/seller/freaks-4u-gaming-gmbh-ew7f/agb. Upon first entry, the ticket must be presented. After presenting the ticket and providing proof of age, Visitors will receive a festival wristband and LAN Participants will receive a LAN Participants wristband. If applicable, Visitors also receive a wristband serving as age proof (for persons ages 16 and above). The wristbands must be worn for the duration of the event. Visitors and LAN Participants are allowed to leave the event site, re-entry will only be granted upon presentation of their wristband.

Access to the festival is granted to persons from the age of 12. Persons below the age of 12 will not be granted access, even if accompanied by a parent or legal guardian. The festival area is divided into two areas: One area suitable for persons ages 12 and above (“12+ area”), and another area suitable for persons ages 16 and above (“16+ area”). Access to the 16+ area is only granted with the additional wristband serving as age proof, issued upon grant of access to the festival.

Participation in the LAN is permitted from the age of 18. Access to the LAN area is reserved for LAN Participants, Visitors cannot access the LAN area. LAN Participants however have access to the event areas without an additional wristband for age-verification.

When entering the event site, security checks can be carried out by the on-site security service (e.g. bag checks). Visitors and LAN Participants agree to this.

The Organizer reserves the right to refuse a Visitor or LAN Participant admission to the event site for important reasons. An important reason is in particular, but not exclusively, the carrying of prohibited objects according to Section 8, an obviously heavily intoxicated state of the Visitor or LAN Participants, if the Visitor or LAN Participant is obviously under the influence of drugs or the Visitor or LAN Participant has an obviously homophobic, sexist, racist or inhuman attitude. Entry will also be denied if the protection of minors is violated. If there is an important reason for the refusal of admission, the tickets lose their validity, and the admission price will not be refunded.

Access to the LAN area

With each purchased LAN ticket (BYOC LAN Regular Pass, BYOC LAN Premium Pass), the LAN Participant receives a space in the row of tables and a chair (depending on the ticket conditions). Seats are allocated using a separate seating map. In addition, the LAN Participant is given the right to stay within Gamevasion for the duration of the event in accordance with the opening times of the respective event areas.

Access to the LAN area and use of the LAN infrastructure is only permitted if the following conditions apply: The participating person

  • has a valid ticket
  • has a valid seat reservation
  • has reached the age of 18 and
  • has had their identity and age verified by presenting an official photo ID (identity card, passport or driver’s license) at check-in.

If the LAN Participant’s identity or age cannot be verified, the Organizer is entitled to refuse the LAN Participant access to the event. In this case, the ticket price or booked additional services will not be refunded.

Cosplay rules

To ensure a safe and pleasant experience for all guests at Gamevasion powered by DreamHack, the following additional regulations apply in extension of the house rules of Deutsche Messe and our conditions of participation:

  • Cosplays must be suitable for visitors aged 12 and over: Excessive depiction of violence is prohibited and buttocks, private parts and breasts must be covered adequately.
  • Costumes must not be dangerous to yourself or others. Carrying them along is at your own risk.
  • Costumes must not have any sharp edges or corners. Parts of armor made of solid materials must be designed in such a way that they do not pose a risk of injury.
  • Drags or tails should not be longer than 1 meter.
  • The overall dimensions of the costume, including wings, must not exceed 2m in width and 2.5m in height. Weapons that exceed the maximum permitted dimensions, even if they can be dismantled, are not permitted.
  • All weapons must be carried safely and respectfully and must not be swung or wielded.
  • The following materials are prohibited:

    • any kind of metal (if the metal content is predominant),
    • plexiglas (especially for imitations of cutting or stabbing weapons),
    • wood from a thickness of 3cm (e.g. baseball bats).
    • In particular, reference is made to point 9.

All weapons will be checked at the entry control. If a weapon is deemed inadmissible, it must be deposited there and can be collected again when leaving the premises. We reserve the right to expel a person from the premises in the event of a breach of these rules or improper handling.

Course of the event

The house rules of the operator of Hannover exhibition ground, Deutsche Messe AG, also apply.

The instructions of the employees of Deutsche Messe AG, the Organizer and the helpers deployed must be followed.

Visitors and LAN Participants are obliged to act in accordance with the law throughout the duration of the event and not to intentionally disrupt the event. Every Visitor and LAN Participant must behave in such a way that they do not endanger or harm anyone else.

Gamevasion has a zero-tolerance policy against any form of discrimination, including but not limited to:

  • demeaning language,
  • threats,
  • intimidation,
  • Photos or recordings that are made without the appropriate consent,
  • inappropriate physical contact,
  • discrimination based on race, religion, sexual orientation, nationality, age, body size and gender.

The zero-tolerance policy is binding for every LAN Participant, Visitor, employee, exhibitor and also for the press. We encourage everyone to immediately report any sign of discrimination to a member of staff or the police. Persons who violate these rules will be expelled from the site with immediate effect.

At Gamevasion, the consumption of drugs or alcoholic beverages not purchased on site is prohibited.

Equipment and objects brought along are to be supervised by the Visitors or LAN Participants themselves. The Organizer assumes no duty of care and excludes any liability for damages and loss or injuries during the transport of the equipment/objects and setting up of the LAN Participant’s space and equipment. The exclusion of liability is also not restricted by any security measures taken by the Organizer or Deutsche Messe.

Extensions or changes to the equipment and technical infrastructure of Gamevasion, in particular the commissioning of your own server, WLAN point or router with the Gamevasion network is not permitted.

Only one chair per space is allowed in the LAN area. Conventional office or gaming chairs are allowed. Stacking multiple chairs is prohibited. Bringing armchairs, sofas or similar furniture is not permitted.

Laser pointers are prohibited.

Bringing PA equipment or large speakers is not permitted. In order to keep the noise level as low as possible, LAN Participants are asked to use headphones.

The LAN Participants are responsible for keeping their space and the surrounding area free of waste. Waste is a highly flammable material and is therefore also a fire hazard. LAN Participants are asked to throw their rubbish in the waste bins provided.

LAN Participants are obliged to leave their spaces in a tidy state after the end of the event. Objects brought along (e.g. computers, monitors, chairs) must be removed from the event site. Items left behind will be kept by the Organizer for a period of four weeks after the end of the event. The owner can pick them up at the exhibition center upon presentation of proof of eligibility. There will be no postal delivery. At the end of the four weeks, items left behind will be handed over to the lost and found office of the city of Hanover.

Network and Power

LAN Participants are obligated to only use LAN access provided by the Organizer (such as accounts, seating map, Internet/W-LAN etc.) with proper use of the access data provided (ID, password) and not to circumvent any access restrictions. LAN Participants are responsible for keeping their password secret and not allowing any third-party access to their account via their password. LAN Participants must inform the Organizer immediately of any unauthorized use by third parties. They bear the costs and damage caused by unauthorized use of the access data by third parties if and to the extent that they are responsible for the unauthorized third-party use.

LAN Participants are responsible for the security of the data traffic. LAN Participants are aware that unencrypted, wirelessly exchanged data may be viewed by third parties. The use of the Internet is at the LAN Participants’ own risk.

Equipment and devices that the LAN Participants bring with them for use will not be checked by the Organizer for suitability, security and suitability for operation. The use of these items and devices is at their own risk and responsibility.

LAN Participants may not violate legal prohibitions, the rights of third parties (name, copyright, data protection rights, etc.) or common decency with the form, content or intended purpose of their Internet use. In particular, the LAN Participants undertake not to display, make publicly available or disseminate any copyrighted content, pornographic, violent or racist content, not to call for criminal offenses or to provide instructions for this.

If LAN Participants violate legal regulations or the rights of third parties and if LAN Participants are responsible for this, they are liable to the Organizer for compensation for all resulting damage.

The Organizer reserves the right to block the WLAN or network connection without prior notice if LAN Participants or a third party violates the provisions of these terms of use or the house rules using the identifiers and passwords assigned to them. The Organizer’s remuneration claims remain unaffected in such case.

Disturbances and failures of the network and the WLAN connection are rectified as quickly as possible to the best of our ability during the service hours. An operating guarantee is not assumed in this case. Disturbances and failures must be reported to the Organizer immediately; otherwise, a speedy processing of the fault and the restoration of the WLAN or network connection cannot be guaranteed. The Organizer assumes no liability for fluctuations or failures in the electricity network or for faults caused by undervoltage or overvoltage.

Each seat has one (1) power outlet. The LAN Participants must bring their own distributors and connect them to the socket provided. The use of electricity from the neighboring site is prohibited. LAN Participants are asked to use good quality power cords and extension cords.

Tournaments

In principle, every LAN Participant has the opportunity to take part in the tournaments and side events offered as part of Gamevasion. Participation depends on the available slots and can therefore not be guaranteed. There is no entitlement to tournaments and side events. The Organizer reserves the right to cancel tournaments and side events at any time.

The tournaments and side events are based on separate regulations regarding registration, start, procedure, point allocation and ranking system. LAN Participants are required to abide by the rules announced prior to the tournament or side event. The Promoter reserves the right to revoke eligibility to participate in the tournament or competition in the event of violations.

The LAN Participant must procure any software and hardware required for participation in a tournament or side event themself, unless the Organizer expressly declares that they will make the software and/or hardware available.

The Organizer reserves the right to reward successful tournament and side event placements with prizes provided by cooperation partners or sponsors. In such a case, the Organizer will announce the prices for the corresponding placements before the start of the tournament or side event.

Prizes must be picked up during the official awards ceremony. Forwarding or earlier prize handover does not take place. LAN Participants who are unable to collect the prize in person have the option of nominating an authorized recipient with the organizer of the respective tournament or side event. If a prize is not accepted by the winner and the organizer of the tournament or side event has not been named a person entitled to receive it, the LAN Participant’s right to receive the prize lapses.

The LAN Participant of a tournament or side event consents to their name being published on leaderboards and at the awards ceremony. Both the name and contact details of each LAN Participant who has qualified for the league may be passed on to other leagues.

Participation and the awarding of prizes take place under exclusion of legal recourse.

The above points also refer to participation in festival tournaments outside the LAN area and also apply to festival Visitors.

Security

It is not permitted to hang clothing or other easily flammable material over the network equipment or electrical system.

Bringing and using the following devices is prohibited: toasters, microwaves, coffee makers, refrigerators, spotlights or any other device that uses a lot of electricity and emits a lot of heat. Conventional fairy lights and 230-volt light bulbs also pose a fire risk and must only be used with increased caution. Fairy lights and incandescent bulbs must not be covered with flammable material such as paper, plastic or clothing. The Organizer’s employees may confiscate the property in the event of unsuitability or increased risk to safety, for the duration of participation in the event.

It is not permitted to stow objects in the aisles. The aisles within the LAN area must be kept clear in the event of a fire. Personal belongings should be stowed under each table.

If LAN Participant’s computers cause problems (e.g. due to viruses, attacks, etc.), these will be taken offline until the problem is solved. If the respective LAN Participant refuses to disconnect, they can be expelled from the site.

Each LAN Participant should take appropriate precautionary measures to protect against viruses, spyware, etc. Each LAN Participant is instructed to have an up-to-date virus program and a firewall installed.

Conditions for bringing devices into the LAN

For security reasons and to prevent theft, LAN Participants must register the following devices with the Organizer at the registration desk before these devices may be brought onto the event grounds of Gamevasion:

  • PCs
  • Laptops
  • Monitors

The Organizer reserves the right to make the admission of further devices for the event, which are not mentioned under Section 6.6.1, dependent on registration.

In the course of the registration the LAN Participants have to state their name and telephone number, to identify themselves with a photo ID and to show their ticket. Optionally, address data can also be specified to extend the protection.

The registered devices will be provided with a bar code sticker (“Security Sticker”) by the Organizer’s security staff. It is mandatory that the Security Sticker remains on the device for the entire time the device remains on the event premises.

Should LAN Participants notice any tampering, soiling or other damage to the Security Sticker during their visit, they must report this immediately to the Organizer at the registration or information desk.

When leaving the event area, the Security Stickers on the devices will be read, the identity of the LAN Participant will be checked and compared to the registered data. If the device is not registered to the LAN Participant, the identity of the LAN Participant cannot be verified or the Security Sticker cannot be read out due to e.g. damage, the Organizer reserves the right to take the device into custody until the ownership situation has been fully clarified. If there is a suspicion of a criminal offense (e.g. theft, embezzlement, etc.), the Organizer reserves the right to call in the police. The costs incurred for any measures in connection with the identification must be borne by the LAN Participants, if they are responsible for them. LAN Participants expressly agree to this procedure by registering their equipment.

The Organizer does not guarantee that a lost registered device can be found or recovered. Nevertheless, the loss of a device with a Security Sticker should be reported immediately by the LAN Participant to the registration or information desk. LAN Participants are not entitled to the admission of their device to the event.

Any equipment, with or without a Security Sticker, found after the end of the event will be handed over to Messe Hannover’s lost and found office for further safekeeping.

Registration of the devices does not imply acceptance of the devices from a technical and/or legal point of view.

Registration of the device does not imply acceptance of the device in technical and/or legal terms. The registration of devices does not imply any kind of liability or warranty on the part of the Organizer for the devices brought by the LAN Participant. It merely serves to facilitate the identification of equipment.

Protection against infection

In order to meet possible official participation requirements for participation in major events, Visitors and LAN Participants undertake to fulfill these requirements (e.g. PCR entry or exit testing, rapid antigen test, etc.) at their own expense and expense.

Visitors and LAN Participants agree to provide the Organizer with a possibly necessary digital or analogue anamnesis sheet about their own state of health. Visitors and LAN Participants also agree to provide digital or analogue information, if necessary, via an automated data comparison about vaccination and/or test status.

Visitors and LAN Participants undertake to refrain from participating in the event if they have physical symptoms that indicate an infectious disease (SarsCov2, flu, cold, etc.). If symptoms occur that may indicate an infectious disease, Visitors and LAN Participants undertake to point them out and to contact the local medical service.

The Organizer reserves the right to take suitable and necessary infection control measures to protect Visitors and LAN Participants to the event from serious infectious diseases (e.g. rapid antigen test upon entry, PCR testing, fever measurement, etc.). This also applies if the measures are not officially prescribed. Visitors and LAN Participants agree to assume any costs incurred at their own expense. There is no entitlement to the implementation of special measures.

The Organizer can prescribe special rules of conduct for Visitors and LAN Participants to the event and order measures (e.g. rules of keeping distance, obeying hygiene rules, wearing protective masks, path/walking direction restrictions, quantity limits, temperature measurements, test requirements). Visitors and LAN Participants undertake to observe these guidelines and to follow them. Visitors and LAN Participants who do not observe these requirements or do not follow them can be expelled from the event site.

Visitors and LAN Participants must find out about the current measures before visiting or participating. The Organizer will provide this information accordingly.

Prohibited items

The following items are prohibited on the entire event site:

  • Animals/pets, weapons of all kinds (also in the technical sense), so-called selfie sticks, torches, pyrotechnic objects, sparklers, sky lanterns, vuvuzelas, megaphones, drones, firewood, bulky waste (old sofas, armchairs, building materials, wood, etc.) shirts with anti-constitutional and legally prohibited depictions as well as dangerous objects of any kind
  • without prior written permission: photo, film, video cameras or other recording devices which, based on their equipment, type and size, are obviously not only for private use.

Cosplay, LARP weapons and props are subjected to a security check by the security staff at the access control. The Organizer reserves the right, at its own discretion, to classify such objects as dangerous and to deny Visitors and LAN Participants access with these objects. The Organizer also reserves the right to classify objects previously classified as non-hazardous as hazardous and to take possession of them and store them temporarily, even after admission to the event. The Organizer is entitled to take possession of prohibited objects and keep them temporarily.

Liability of the Organizer

The Organizer shall only pay compensation for damages and reimbursement of futile expenses regardless of the legal grounds (contract, tort), to the following extent:

  • in the event of intent, gross negligence and in cases in which the Organizer has expressly and in writing assumed a contractual guarantee or the procurement risk;
  • in all other cases only in the event of an essential breach of a contractual obligation, without which the achievement of the respective contractual purpose would be jeopardized and on the fulfillment of which Visitors and LAN Participants may therefore rely, as well as for default and claims from liability for defects / warranty, but limited to compensation for typical and foreseeable damage.

The Organizer is not liable for lost or damaged items. Parking in designated parking spaces, as well as leaving hardware, equipment, luggage, jackets and other objects on the event site unsupervised by Visitors and LAN Participants, is at their own risk.

Insofar as the Organizer’s liability is effectively excluded or limited according to the above rules, this also applies to the personal liability of employees, other employees, organs, representatives and agents of the Organizer.

Legal liability for personal injury and under the Product Liability Act remains unaffected.

The Organizer is not responsible for disruptions, delays and/or damage caused by force majeure, in particular natural phenomena and official orders.

Video/Sound Recordings

The Organizer, its cooperation partners and agents are permitted to make audio and video recordings throughout the event. For the purpose of documentation, information and advertising, every Visitors and LAN Participants irrevocably agrees to the free use of their picture in all current and future media formats (print, electronic storage media, Internet, in the press and in other media, e.g. radio and television, via cable and satellite, including all transmission protocols and transmission formats). If Visitors or LAN Participants do not agree to this, participation in the event is not possible.

Visitors and LAN Participants are prohibited from making audio and video recordings and drawings, in particular of trade fair stands and exhibits, for commercial purposes on the exhibition grounds without the prior written permission of the Organizer.

For security reasons, the event rooms can be video-monitored for the entire duration of the event, taking into account Art. 5 (2) DSGVO for the prevention and, if necessary, prosecution of criminal offenses, such as theft of hardware or peripherals provided by the Organizer; this monitoring takes place separately from the recordings referred to in paragraph 9.1. Recordings obtained in this way are used exclusively to clarify behavior relevant to criminal law. The recordings will be deleted 72 hours after the end of the event. In order to clarify behavior relevant to criminal law, the 72-hour retention period can be deviated from and the recording can be released to the responsible authority.

Privacy

The Organizer processes the personal data of Visitors and LAN Participants in compliance with the relevant data protection regulations, which can be found at https://www.gamevasion.de/privacy-policy. The personal data (in particular name, address, telephone number, e-mail address, image and sound recordings) are used by the Organizer in the manner necessary for the establishment, design, modification or fulfillment of the contractual relationship, as well as the image and sound recordings described in 10.1 collected, processed and used to the required extent.

If the Organizer is sued for a violation of the law, e.g. in the case of improper use of WLAN, the name and address of the user can be passed on to the competent authorities or persons who can credibly demonstrate a violation on the basis of Article 6 (1) (c) DSGVO, to be passed on.

Visitors and LAN Participants can object to any legally permitted use or transmission of their data for advertising purposes or purposes of market or opinion research at any time in accordance with Article 21 (2) DSGVO and revoke any consent given in this regard. Visitors and LAN Participants will be informed about this right of objection for each advertising approach.

Miscellaneous

In addition to the Conditions of Participation, separate and supplementary conditions (in particular the house rules of Deutsche Messe AG P) apply, in particular with regard to access to the events and halls, the organization of the event and public safety and order in the Hanover Fair. The domiciliary rights are exercised by the Organizer, Messe Hannover and its stewards and security staff.

If any part of these terms is or becomes illegal, invalid, unenforceable or in conflict with any relevant jurisdiction, the validity or enforceability of the remaining provisions remains unaffected. The illegal, invalid, or unenforceable provision is to be replaced by a mutually agreed provision that is best suited to achieve the desired economic purpose under consideration of the interests involved.

These terms shall be governed by German law excluding its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sales of Goods (CISG) is excluded.

To the extent possible under applicable law, venue for all disputes in connection with these terms shall be Berlin, Germany. Where Visitor or LAN Participant is a merchant (Kaufmann/-frau) under German commercial law and/or has their registered office outside Germany, the Visitor or LAN Participant submits to the exclusive jurisdiction of the courts of Berlin.

Raffles

If the Organizer conducts raffles through its media channels in the future, the terms and conditions for participation in such raffles will be linked here.
